They may be suing each other in a civil court, but the DA won't be pursuing any criminal charges against either Jayde Nicole, Joe Francis or Brody Jenner for their bust-up the night of August 28th.

After pouring a drink on him at Guys and Dolls, Jayde claimed that Joe physically attacked her, "by pulling on her hair from behind to gain maximum control over her person and then violently shoving and/or throwing her to the ground of the nightclub like a rag-doll, a claim that Joe fervently denied... until the security tape from the club was released proving Jayde's story! But apparently that wasn't enough for the DA to pursue criminal charges against them.

"The interests of justice do not support the filing of criminal charges against any of the three suspects," says a LA County DA's charge evaluation worksheet.

The sheet cites the security video which captured Jayde and Joe's fight inside the club, and says "Suspect/Victim Gelette (Jayde) appears to have acted without immediate provocation in her assault upon Suspect/Victim Francis," while the fight between Joe and Brody "was not captured on camera."

I guess that means that the court in the civil cases will just have to depend on he said/she said/he said!
