michaelkatewalkingsnag460wm.jpgMichael Lohan fears for his safety when it comes to ex-fiancee Kate Major ... so much so that he's filing a restraining order against her when he arrives back in New York. He'll be home on Sunday night, but Monday morning, Lohan says he's heading to court to file the papers.

Earlier this week, Major filed a police report in Southampton, NY, claiming Lohan had abused her. Police then charged him with 2nd degree harassment.

Lohan tells X17online exclusively:

    "First of all, the wedding is totally off. Thank God. And yes, I'm getting a restraining order. When Kate drinks, she gets completely out of control. This whole abuse situation is made up. If I had abused her in any way, I would have been charged immediately with a misdemeanor, but I never was charged with that because nothing happened to her. She's no longer going to be a part of my upcoming reality show, Celebrity House NY. In fact, she has already moved out of my house. It's over."


In response to this, Kate Major tells X17online:

    "I’m devastated that Michael is making false accusations and I just want to be left alone. He knows and I know the truth."


Lohan also tells us that Major had been jealous that Rachel Uchitel was going to be appearing on Celebrity House NY ... a LIVE, 24/7 online streaming reality show with Lindsay Lohan's father and a wide cast of characters living together in a Southampton home. Rachel has publicly denied that she'll be a part of the show, however Michael tells X17online:

    "She won't be a permanent part of Celebrity House NY, but yes, Rachel will be staying in the house for a week or so. She's going to be busy with Celebrity Rehab now, but she will make time to appear on our show, too. Everyone has to realize, I'm the one who helped her book Celebrity Rehab in the first place."
