The recent divorce filing by Billy Ray Cyrus from his wife Tish on Tuesday may have a huge effect on who gains control over Miley Cyrus' reported $1 billion bank account, as the teen superstar's 18th birthday rapidly approaches.

At the moment, both of Miley's parents are her co-managers. They both have equal decision-making power and are paid what is assumed to be an equal salary by Miley. But with a divorce pending and Miley on the brink of legal emancipation next month, Billy Ray and Tish could be getting nervous about their which of them may or may not continue to play a managerial role for their daughter or if she'll decide to fire them both!

J. Michael Kelly, a Santa Monica attorney who has been handling high profile divorce cases for over 40 years (but who does not represent either of the Cyruses), chatted with X17online about this high-profile divorce and how Miley's Nov 23 birthday may affect her parents:

    "At 18 [Miley] can say who she wants to handle everything, she could chose both parents, one, or neither.

    Billy Ray and Miley are the economic drivers of the family, and Tish doesn't have a career of her own. If there was no prenuptial agreement involved, Tish could become a very rich woman. She could go for half of their income.

    She most likely has lawyers and advisers to petition Billy Ray, and people who run the Hannah Montana franchise have a huge interest in Tish's well-being. She could end up running this franchise herself. No matter the outcome, Tish will be well taken care of."


Kelly believes the pair will most likely use a private judge to settle the divorce so that no further deals are publicized.

Billy Ray expressed his feelings about the divorce via Twitter:

    "He will cover you with his feathers and under his wings you shall take refuge. Truth will be your shield and buckler.
