Halle Berry has been battling baby daddy Gabriel Aubry for custody of their daughter Nahla since they split, and things are about to get a whole lot nastier if the Oscar winner succeeds in proving to the courts the paparazzi are a significant threat to her daughter's safety and she should be allowed to move to France with the 4-year-old.

The actress is going to court today to convince the judge it's in Nahla's best interest to live in France, where it's a crime to harass celebrities in public -- despite the fact her biological father is based in Los Angeles. To best illustrate her point, Berry and her lawyers intend on making a video presentation, showing examples they believe prove the dangerous lengths particular photographers go to capture a shot of the mother-daughter duo.

In one specific incident, Berry had to call the Beverly Hills Police so she and her little one could make an exit from a restaurant. In another, shown above, the 46-year-old star loses her cool when a shooter gets overly aggressive at her daughter's school. The Dark Tide star has subpoenaed paparazzo Andrew Deetz, who allegedly trespassed on the grounds of the pre-school.

It is unclear whether Canadian model Aubry will be present in court, and no comments have been released from his camp.
