lohan-assault-230.jpgPolice have dropped assault charges against Christian LaBella, the man who allegedly attacked actress Lindsay Lohan in NYC over the weekend, but the case is not closed as Lohan and LaBella have filed harassment claims against each other.

LaBella had initially been charged with two misdemeanor counts of assault and two counts of harassment, but this morning NYPC Deputy Commissioner Paul Browne told CNN, "Cross complaints for harassment were filed and LaBella's assault arrest was voided after detectives investigated further."

According to reports, the two met at 1Oak nightclub in NYC on Saturday night and Lohan invited LaBella back to her room at the W hotel. They then reportedly got into a fight after Lohan discovered that Labella took photos of her on his cell phone, and the 26-year-old starlet claimed she was punched and choked by LaBella.

After the incident occurred, Lohan's rep told X17online, "Lindsay was assaulted early this morning in a New York hotel. While she did sustain some injuries, she was not hospitalized. The assailant was arrested and is currently in police custody. Lindsay has spoken with police and is fully cooperating with the investigation."
