The day after Usher and Tameka Foster's oldest son nearly drowned in a pool, the celeb stylist filed legal documents in Fulton County, Georgia asking for an emergency custody hearing.

Foster is demanding custody of their two boys, Usher Raymond V, 5, and Naviyd Ely Raymond, 4, claiming that Usher is allowing unfit people to care for their children, thus creating an unsafe environment. Usher filed for divorce from Foster in June 2009 after nearly two years of marriage and he currently has primary custody of their children. While it seems like supervision is an issue, this isn't the first time tragedy has struck the family: In July of 2012, Foster's 11-year-old son Kile Glover died after being hit by a jet ski while in Georgia's Lake Lanier.

Usher Raymond V was rushed to a local hospital after nearly drowning on Monday at the singer's Atlanta home. According to reports, the little boy attempted to get a toy from the pool drain but his arm got stuck, and when his aunt and a maid weren't able to free him, two male employees finally came to the rescue and pulled him to the surface.
