She can't seem to catch a break!

Real Housewives of New York star Luann De Lesseps is being sued by her ex-husband and their two kids, for breaking the terms of the divorce settlement and failing to set up a trust for the children.

Count Alexandre de Lesseps and Victoria and Noel De Lesseps filed court papers this week, alleging the Bravo star purchased a $3.1 million Sag Harbor, New York, home back in 2013 with the money from her divorce, and never followed through with setting up a trust for their offspring as promised.

"Defendant has never, since her purchase of the Premises, created the Trust or conveyed to her children, in Trust, an undivided one-half interest in the Premises," the court papers read.

The reality star apparently let her family know this past week that she intends to sell that place and take the money she gets to buy another home in upstate New York. Needless to say, they're NOT cool with that!

Her former spouse and the two children want the court to issue an order that requires her to create the trust and give the kids "an undivided one-half interest" in the Sag Harbor house, as well as "render an account as trustee for her children, and petition for judicial settlement of same, on notice to Plaintiffs."

Money can't buy you class... but you also can't stiff your kids out of money and get away with it, either!
