Abercrombie Sues Beyonce For Being A Bit Too Fierce!

We knew Beyonce was getting her own fragrance, but it looks like Abercrombie & Fitch is getting fired up over the fact that B wants to name it after their trademark scent!
Women's Wear Daily reports that A&F filed a lawsuit yesterday seeking to preempt any fragrance launched under the name of Beyonce's uh, "alter ego", Sasha Fierce. In a complaint filed in US District Court in Columbus, Ohio, Abercrombie said it began selling Fierce in 2002 and trademarked the fragrance in 2003. It's pretty much their most popular men's cologne, and you can smell it when you walk by any A&F store, so Beyonce HAD to have known about it right?
According to court documents, Beyonce filed a letter-of-intent application with the U.S. Patent and Trademark Office last September for the Sasha Fierce mark in the fragrance category. A&F said its attorneys sent a cease-and-desist letter to the R&B star after they became aware of her intent, but apparently Beyonce has continued to pursue the trademark.
Think A&F will win this one? Or will Beyonce have her way? I mean if she names it Fierce that's totally uncool, but if she's simply calling it Sasha Fierce, that's not that big of a deal is it?
Personally we think Sasha Fierce is completely ridiculous, so we wouldn't mind if the overpriced retailer wins this battle!

I agree, if she names it Fierce there is a problem for sure. You can not steal a trademarked name. Its illegal no matter who you are. However, if she names it Sasha Fierce by Beyonce, then its a totally different name and just happens to have one of the same words and is clearly not the same thing. Its not like someone will go to A&F to buy perfume by Beyonce and someone looking for A&F cologne will not go to a department store looking for Fierce. So as long as the names not the same, who cares?!
ugh..its just like beyonce to do something illegal even after they warned her because she thinks she can get away with it..its a dumb name anyway..and this will serve as proof a year from now that beyonce was WARNED and continued to do it anyway..im for a&f on this one..SUE THAT BITCH FOR ALL SHE'S GOT!!

Fierce is just a word. Beyonce will win. Unless A&F's fragrance had an absolute unique name then they would win hands down. Not to mention Sasha Fierce was already used as her album name so it's not like she is intentionally seeking to rip off A&F's fragrance. Remember when the Red Hot Chili Peppers tried to sue Showtime for using "Californication"? Well TRHCP lost because the term Californication was used way before it even became a song. A&F needs to chill out. A&F's demographics are different from those of Beyonce's. She targets classy women shopping at department stores. A&F targets uber rich tweens.
She will lose. You can't TM something in the same class (both perfume) a confusingly similar name. USPTO will not allow anyway; her application was probably refused already and her money seeking attys are still fighting so they can bill her more money. LOL
Beyonce is overboard with her attitude. Name a fragrance for Beyonce, call it "Head First", after her popular fall during a stage performance. That looked funny alright, but I'm so glad she wasn't seriously hurt.
" Head First" ? I'll buy that. What did Beyonce say," hey, that doesn't taste like a lollipop?" LOL.
