"Witnesses reported six police cars, an ambulance and a fire engine surrounding the house within a gated community in Los Angeles.

LAPD spokesman Jason Lee said: "Police were called to Britney Spears mansion this evening.

"She was refusing to hand the children over to their father as part of a court order.

"We were called and the situation is now what we call a Code 4 - which means everything is done.
"That means we verified the court document and the children are being returned to their father via representative.

"However we do believe Britney Spears is under the influence and needs to be evaluated.

"She is being transported to hospital where she will be tested for both drink and drugs.

"At this stage we do not know what she may or may not have taken - that's while she needs to be evaluated.

"But obviously if the test does prove positive then we would be looking to move her to a police station and charge her.

"But again I cannot say if that will happen for sure until we get the evaluation test results."

The drama started earlier on Thursday evening, when Spears refused to hand over her two sons to her ex-husband, Kevin Federline. Federline has primary custody of both boys, who are the subject of ongoing custody negotiations.

The incident occurred hours after the singer appeared for a brief, but long awaited deposition in her child custody battle with ex-husband Kevin Federline.

Spears was deposed for just 14 minutes, Federline's lawyer Mark Vincent Kaplan told reporters after Spears left.

Paparazzi sprinted after the singer, clad in a hot pink dress and sunglasses, as she drove away. Security guards dashed across the driveway to keep photographers on the footpath.

Spears called in sick for a December 12 court ordered deposition, but was photographed that day driving with a friend. She also did not show up for a session yesterday, Kaplan said.

Spears' lawyers from the firm Trope and Trope yesterday filed a court motion asking to be relieved due to a "breakdown" in communication with their client. Kaplan said Spears' lawyers were present for what became a very abbreviated session.

"The deposition proceeding did go forward today. It was scheduled for 9.45 to 11.45," Kaplan said. "However, it wasn't able to commence until 11.32."

"You can imagine in 14 minutes there's not a lot of time to develop questions," he said.

Kaplan said another deposition will be scheduled.

Spears' representatives did not speak to reporters outside the office building.

Spears and Federline have been wrangling over custody of young sons Sean Preston and Jayden James.

Federline has temporary custody of the children and Spears has limited visitation rights. The two were married in October 2004 and divorced in July"

To read x17's headline and caption, I almost spit my coffee out. Guess they left a few details unsaid. How can you spin this dangerous incident? She's a monster in need of a lengthy "hospital" stay for her MENTAL health. If it turns out that she hurt her son, how will you ever spin that? This site is disgusting. You're not helping her at all. And you are certainly making money on her escapades. You could at least tell the truth....you still get the story. She's been a danger to herself and her family for some time. Britney Spears may have torpedoed herself in her custody battle.

L.A. County Commissioner Scott Gordon laid down the law for Britney, mandating that she and K-Fed be drug- and alcohol-free while they have physical custody of the children.

Depending on what Brit was under the influence of, K-Daddy's lawyer Mark Vincent Kaplan could go back into the court and immediately ask the judge to strip Britney of visitation rights.
