This case is not going to federal court because Eardley does not have standing to represent Spears. Even if he did, it's doubtful there's a federal court that would take this case at this time. I work in a law office that specializes in civil rights. I was stunned by the Commissioner's ruling. EVEN IF it was justified to February 14th, after that, it definitely was not. Our country's constitution was specifically created to avoid such a violation of rights as Britney is suffering. Even if her Dad means well, this is outrageous and unlawful. Even if it is a ruling by a Commissioner, it is an unlawful ruling and some court will come forward and say so. This is one of the most shocking things I have ever seen. This is so brutal. No one (except for attorneys) seems to realize how awful is what is going on to Britney Spears. You have to try to completely put yourself in her position and see how you would feel. It's scary and unlawful. I completely support the new attorney who is trying to have Britney regain the rights that you and I and everyone in America is entitled to.

Britney has Bi-polar which causes mood swings and crazy behavior. Highs and Lows as if she were on drugs. One min that person is happy and normal and the slightest change in their schedule can make that person very sad. Their moods can change in the blink of an eye. Most bi-polar patients can be treated with medication it is just a matter of finding which combination works best for that person and it does take time to figure that out. What people are not understanding is that even though Britney has this condition she isnt unable to fix food or wipe her ass or talk on the phone or drive a car. So YES Britney's Civil Rights are being violated and it isnt fair that someone can just step in and take over another persons life like her parents have. Look at it this way when addicts have a problem their parents cant just step in and take their lives away. They cant have them committed to rehab or take away their Civil Rights. Well, okay, I can see why the conservators would have control over her business affairs. But, does that mean they can have control over all her comings and goings? Seems to me she should be able to. And, maybe the reason why she doesn't seem "happy" is because she no longer is willing to play around with the paps, now that she is off her meds. After all, her dad never smiles when he's photographed by the paps. Is he a prisoner, too? When she was out shopping with her mom, she seemed happy; when she was at the dance studio, she seemed happy. We saw pictures of her smiling then.

This is because Mark Kaplan's old spokesperson, who was close to him and knew the details of the Federline custody battle (which is the basis of the suit they are attempting to move to federal court), is now the spokesperson for the new attorney.

The hospital had to release her. She was NOT considered a danger to herself or anyone else. The Commissioner is allowing her to be controlled with her own money as her Dad uses Bodyguards not to protect her but to control her. To physically stop her from exercisng her own will. She has not even been evaluated by a court shrink yet. NONE of the allegations were investigated. People can say ANYTHING and I am sorry but Lynne's story was extremely skewed. Do you really think that Sam is that stupid to have said those kinds of things to her family? And why would Lynne wait three days if she thought that was really happening to her daughter? If Britney's on the right meds, she shouldn't be driving anyway! I'm sure the script label includes something like, "Do not operate machinery or drive." On the other hand, if she doesn't know what insomnia is, I doubt if she'll understand not driving. While I was at my opthamologist's office this morning, I read a feature story in a magazine, November 2007 edition, about women who became gambling addicts. One woman was in her late 50's when she became addicted, ruined her marriage and bank account. Her brother went to court and was granted a conservatorship over the sister. She commented that even now she must have his permission to spend any of her money. The difference between her and Britney appears to be that the woman in the feature realizes she has a serious addiction and now accepts it's in her best interests not to be in control of her assets. My co-worker once had a conservatorship over her sister who is bipolar and could not function properly. I, myself, petitioned the court causing my uncle to be committed even though he didn't think he was mentally ill.

My point is it appears the law and courts recognize that sometimes adults don't have the reasoning or resolve to resist that which might be harmful and detrimental to the individual's life or to others. If a concerned party such as a family member steps in the court can allow the petitioner to oversee and take steps to protect the afflicted individual.

I just don't see what the big deal is; it's just temporary. This is something that happens often in the judicial system even if it's new to many people right now. The state court has give Britney's father and brother the right to make certain decisions for her, and the federal court will probably not interfere. Sam and his publicist must be desperate to gain immediate access to Britney for some bizarre reason. Why won't they just wait until next month's hearing to find out if it's determined that she no longer needs a conservator? Why is Sam alway's hiding out? He was the one always suggesting that Britney was so in control and there was nothing to hide, so I don't get why he's dodging the restraining order like he did the subpeona in the past. It seems like fear to me.

This case is going to be tossed. I've seen the ACLU jump on top of civil liberty cases, but they're being silent thus far on this one. There's a reason for that. She IS being represented by a court-appointed attorney, Samuel Ingham. He may not be of her own choosing, but she has access to him and he can and is required to argue on her behalf. The conservators are not permitted to interfere in her access to him. So...lets see - she's legally represented, she's been shopping, out to dinner, taught dance classes (not a prisoner) - she carries a cell phone everywhere and is seen talking on it (she can call people, albeit on a limited list). Guess that blows the federal filing complaint all to hell. Oh and one more thing - she's been adjudicated incompetent to hire an attorney. Not likely the federal government will have a differing opinion on that. My guess is that a federal judge will turf this back to the state in short order. This is the kind of stuff the feds tend to prefer to leave at the state level unless it's a class action across state lines - and even then it's hard to establish federal jurisdiction. On top of that, nobody - NOBODY - wants to be the ones to make this all just "go away" because Britney wants it to. If that happens, and things go back to "normal" and she DIES, they'll get crucified. Just sayin'....from some dinner conversation last evening... :-)

My best friend tried to kill himself and called me in the middle of it - his family didn't know he was a mess. I called them and they did step in. He's now in outpatient treatment under a conservatorship-type of thing in New Hampshire. He's got no money either, but the point is to get him the treatment he needs and make decisions while he's not fully able. We're three months in and he's doing lots better. Hearing next month to review legal status. He was pissed at first but he's over it now and gets why they did it. Maybe Brit will too if it sticks long enuf! :-)

The impetus for this article is the realization that the scientific basis for these forced treatments is non-existent and they are permanently damaging hundreds of thousands, if not millions, of people. No other field of medicine allows this sort of forced treatment. Of course, there are many people who see psychiatrists and voluntarily, even eagerly, take psychiatric medications. This article has absolutely no complaint about this. It is unwarranted forced treatment that is being addressed. This article also does not address the issue of somewhat more subtle coercion such as "if you don't take the medication, we will take your housing away from you" or "if you don't take your medication, we will have you committed to the mental hospital." This article is solely concerned with using the force of law (court orders) to compel people to submit to unwarranted psychiatric treatments they do not want. What unfolds is a legal system of Catch-22's for the patients and one where the courts have not only abdicated to "professionals" their responsibility to protect the rights of people coming before them, but also condones perjury in furtherance of this abdication.

I am sure she is very frustrated right now. She cannot do any of the things she used to fill her day with---driving around aimlessly, courting photogs, visiting public restrooms, flashing her crotch to the world, and so on.

When you don't have anything meaningful in your life, then you have a pretty bit empty spot all the time. The United States Supreme Court case of Foucha v. Louisiana, 504 U.S. 71 (1992) held that "The State may [in addition to punishment for a crime] also confine a mentally ill person if it shows 'by clear and convincing evidence that the individual is mentally ill and dangerous." (emphasis added) In the recent case of Kansas v. Crane, 122 S.Ct. 867 (2002), the US Supreme Court reiterated:

"[w]e have consistently upheld such involuntary commitment statutes" when (1) "the confinement takes place pursuant to proper procedures and evidentiary standards," (2) there is a finding of "dangerousness either to one's self or to others," and (3) proof of dangerousness is "coupled ... with the proof of some additional factor, such as a 'mental illness' or 'mental abnormality.' "

So, the first thing that jumps out at one is that the "gravely disabled" (or similar) standard for involuntary commitment is unconstitutional, or at least the U.S. Supreme Court has never said it is constitutional.

As is explored at more (but not great) length in Unwarranted Court Ordered Medication: A Call to Action and Psychiatric Myths, the scientific reliability of diagnosing someone with a mental illness is very questionable. Even more questionable is the ability to reliably predict dangerousness. Thus, a vigorous attack on the scientific basis of psychiatric (expert) testimony on these elements can be mounted. In addition, attacks can be made on the way that the psychiatrist arrived at his or her opinion. For example, what was the standard for determining dangerousness? What authoritative work was used that sets the criteria? What level of dangerousness? As is shown by the Corruption in the Courts section, below, the way that most of these commitment orders are obtained is quite simple. They lie about meeting the legal requirements for getting the orders.

With respect to the mental illness diagnosis, itself, when a psychiatrist decides that a person has a mental illness and that person disagrees, according to the psychiatrist, that disagreement just shows the person lacks "insight" and is in itself proof of the mental illness. Catch-22.

In short, the mental disability law system often deprives individuals of liberty disingenuously and upon bases that have no relationship to case law or to statutes.

The guy who recently killed someone was under past psychiatric care, and in several mental hospitals throughout the years. Unfortunately, those hospitals always released him at some point. Psychiatric medicine has been studied much longer than you have been alive. You are not cured of major psychiatric disorders, but they can be controlled and maintained somewhat. Usually, in a severe case, the person must be watched also. A hospital is the best option for those, but again, it is hard to keep people there a lot of the time. I did not say most people who kill are mentally ill, but a lot of them are. It depends on the situation. Having a desire to change does not go along with severe mental disorders. Those people have to be changed, whether they like it or not. The case I referenced is a clear case of mental illness. His own parents say they have been frustrated with trying to keep him in hospitals. You said, "Psychiatry will not cure deep ridden psychosis," but that is not true. Their brains can be altered with the help of medicine. When people stop taking their medicine is usually when they go off and act "crazy" or even kill.

Lurker 2:41, I don't believe it either. The conservatorship is a slippery thing to handle in the best of circumstances, let alone when it gets sloppy like this has gotten. But I do believe that it is in her best interest and don't believe it is the conspiracy that some think it is! So many problems arise between people because of either mental illnesses, diagnosed or not, or personality disorders, where a person simply does not react to situations as we expect "normal" people to react. I think that sometimes after a divorce, one parent "gives up" (usually the father) if they are faced with messy court proceedings or being handed supervised visitation. Sometimes it's easier to move on and start a new family than to have to deal with a spiteful ex who doesn't want to play fair. I've seen it happen with others.

I want to see who I want to see at any time and make it happen (Probably Sam and Adnan. Maybe drug dealers or other lowlifes. We all know what happened with this set of previous friends. Cool talking with you Lurker! One thing that I do want to say is that the meds are obviously starting to have an effect on her now. It is typical to give people strong initial doses of psychotropics and in particular bipolar meds and this will cut off all the strong highs and lows of emotion. Hence, the zombie glaze that is evident in her recent pics. If ever there was a mental Pandora's Box waiting to be opened, it will be when and if she decides to stop taking her meds in any proper fashion. This is very common, especially with bipolar sufferers, that they miss the euphoric highs of their old life and sometimes lapse into a deeper depression because of it. Sometimes they are simply bored. I would bet anything that this is what she misses the most; the euphoric highs and the feeling of excitement and invincibility that come when off meds. No external control of her is the key to opening this Pandora's Box. Oh, btw, the last school shooter was off his meds.

Can I just say that I think its a pathetic that certain celebs keep offering to let Britney "come live with them".

Yup. I dated a bipolar fellow once (back in the "it's lithium or nothing" days. It was awfully hard on him and worse on his family. He'd get manic and nothing, absolutely nothing would stop him and off he'd come from the meds. I can only imagine what it's like to be that high above everything and then have people pestering you to take something that would stop that. I can see where a bipoloar might not care to do that even with the low, low lows.

Yeah, read that about the NIU shooter. Such a tricky thing. Some folks need to be on their meds all the time and yet, how can you (short of incarceration) force someone? And when those who truly need 'em come off? Tragedies happen.

Sad that these families are being blasted apart and with specific focus on Ms. Spears, I think we're not only seeing an actual mental illness but I do think we're seeing someone who was spoilt rotten via fame at far too young an age. Some can handle it, I guess, seems like many cannot.

I guess we'll see how it turns out but I have to say at this point, I'm glad those kids are not with her. Love them she may but she's not in a place to be taking care of them. Learn to take care of herself first.

Not all that well read on the fellow who killed the psych. So I can't fully comment but I do know that the whole system isn't working very well. Since the 70s when the large hospitals started closing down and folk were put out on the streets that shouldn't be, there have been many, many stories that sound similar to this one. Some folks just sound not be out in public. Whether they are truly ill or whether they are just bad. Shame, really, that there are folk like that but there are and to deny it, is to not know humanity.

Lurker, people can argue till they are blue in the face about her NOT being ill, but since she is on meds now, it really is a moot point. And I too believe, that like everyone else who has these mental issues, that it is a totally encompassing thing that is not just based on one factor. Did you notice how opinion shifts on a daily and per story basis? First she was a prisoner being held totally against her will and people were climbing all over themselves saying that it was an illegal conspiracy. Now the other side of it comes and people shift yet again. I, like you I believe, have not varied too much in either of our positions. I think you might be a bit more sympathetic ( and that's not a bad thing) than I am, in that I believe that she needs to take even more responsibility for her actions and that tends to lessen my sympathy for her. Not saying one is a superior way to look at things, just a statement of what seems to be our respective and similar ways of thinking about this.

She never wanted to be a mom to the kids since her divorce. She party for months with paris knowing fully well she had a 2 month old at home and a 13 month. She do not give a damm about those boys. Yeah, I'm a softy. :-)I do agree but I don't think right now is the time for taking responsibility for her actions. I think it's a bit soon. First, get her to the point where she can even begin to think straight, reflect on the past year or three and start learning from her mistakes. But right now, I think it's time to put her back on an even keel. Meds adjusted, more testing done to make sure the MDs know what all is going on there and then therapy. Isn't going to be short nor easy.

And yeah, opinions seem to flip around something fierce. I've been of the mind for quite awhile that she's sick and I think she got there, in part, due to a lifestyle that had no real structure nor responsibility (y'know, day-to-day normal type stuff). I think she created a world to live in and then found herself stuck in it. And getting back, well, ain't going to be easy.

I agree with Lrker Britney needs to be brought to neutrality and along with meds needs education regarding whatever it is that's making her this way.

Her life has probably always been so hectic and chaotic that she doesn't know how to live any other way. Quiet moments alone scare her.

Lurker, I hit the post button before I meant to. I do agree that perhaps she is incapable of being responsible for most of her actions and should focus only on getting better- if she can. I am just more of a hard ass about it, but at least I know that I am like that! But the key to her doing the right thing IS, in my opinion, recognizing that she has issues instead of running from them. Only when she does this will she ever have a chance of succeeding. Shifting and projecting the blame to others is the opposite of handling her problems.

I think most people are guessing as to her state of mind right now. No one knows if she is better. Even if she is taking meds, they very well may not be the right meds, and she may be faking even taking them. It takes a very long time to get the right combo. Her own mother said she has the mind of a child. She may well be bipolar, but she has been drinking and drugging for years. If she is bipolar, that's where it came from. It was drug induced. There is no way she is going to be stable in this short amount of time, and being with her kids is not only dangerous, it's stupid. Giving her any responsibilites at this point would be silly. She is not capable. This is a long road and not one that will be better in a short time. She should be in an inpatient Mental Health Facility where she can be evaluated and diagnosed properly. Just by her calling this lawyer alone, shows she has not accepted she has a problem and can't wait to get away from the people trying to help her. She will see nothing wrong with what she has done over the past because she is incapapble of rationalizing. Until she can, this battle is futile.
