This Family Law court hearing isn't about Britney's rights -- it is about the needs of two little boys. An ex-parte order was changed to a "temporary" order. That's a small step away from a permanent order. Britney basically now needs to prove why the temporary order shouldn't become a permanent order. Even more legally ground shaking was the fact that Commissioner Gordon turned all the Family Law proceedings over to the Children's Services -- they are doing an investigation. If Children's Services finds enough to show abuse or neglect, they could file in Juvenile Court on a Welfare and Institutions 300 case. That would open a whole new matter of intervention. A Juvenile Court order trumps a Family Court order in matters pertaining to minors.

By the way, Britney's family has no legal authority to "get her some help." In California they can only tell what they know -- like witnesses. The authority to "5150" somebody is only those professionals who work for the County government and mental health department. Private doctors have to be under contract to the government. The family does not have the power to do that. If the two professionals won't do that, then the only way Britney can be treated is with her voluntary and knowing consent. In the meantime, those she chooses to have around her are the only ones taking care of her.

I'm shocked by the court's heartless and cruel ruling. A mother must be with her children. She would be if it weren't for the jealous haters trying to take her down for their own selfish reasons.

She and the father can even challenge each other for custody and visitation -- or not. However, if there is a complaint to Child and Family Services about how she is treating that child, then there would be an investigation and another round of hearings in juvenile court.

However, a Juvenile Court tries for reunification and if that fails, can terminate one or both parents' right to custody and place the child with foster parents or adoptive parents. That's why the release of Family Court sealed documents to the Children's and Family Services investigation was a "legal earthquake" for Britney today.

Some posts say she hears voices, she talks to thin air, she believes she can make herself invisible if she wants to, she believes her houses are haunted with ghosts and can't stay in them (voices again), her sleep patterns are all messed up, she can't recognize who she can trust, she spends on sprees, she has hyperactivity phases and deep depression. She can't tell reality from non-reality. She can't manage her affairs, feed herself properly or maintain any relationship with anyone in her family. She is nowhere near well enough to parent a 14 month old and a 2 year old. This removal of her parental access to her children is for the safety of the children. The court also rescinded the orders regarding the parenting coach and court monitor for visitation. The Court recognizes that she is ill. It's not a blame game. Right now the children are better off with their father and mother needs some time with the pressure off. A suspension of parental access is not a permanent denial of parental access. The children are young. Perhaps in a few months or years after Ms. Spears gets better she will have some reunification services and have parental access again.
