Hospital Preparing For Britney's Release!

UCLA Medical Center appears to be preparing for Britney's possible release tonight.
Just after midnight tonight will mark the end of the 72-hour initial hold period of the 5150 hold Britney has been under. So what will happen next?
The Medical Center security has been beefed up since yesterday -- there are guards at the entrance to the building and the paparazzi have been forced out of the parking area.
Doctors were expected to evaluate Britney's condition today and to begin to formulate their recommendation to the court as to whether her 5150 hold should be extended or whether Britney should be given the right to make her own decision as to her treatment -- meaning she could choose to leave the hospital and NOT be treated.

They have to prepare just in case. Until they receive notification from a court they have to plan on releasing her at the end of the 72 hours. I highly doubt she'll be released.
UCLA has labeled her GD. Given as recent as yesterday she was having outbursts in her British accent that status is likely unchanged. Her family and psychiatrist certainly will recommend a longer stay. Osama has no say anymore. So unless a judge decides to go against the advice and let her out, she should be in for another 14 days.

After that, the problem is eventually she will have to WANT to stop using crystal meth, and it is very addictive. It will take weeks for her to completely go through her withdrawals. I knew a girl who's baby tested positive for meth when it was born and did they take that child away?? unfortunately no. she was allowed to live and care for her baby as long as she went into day treatment rehab 3 times a week. It was only a 72-hr lockdown for evaluation purposes and progressing towards treatment IF required - as is the Law.
IF Britney gets out tonight then the Doctors think she is OK as an outpatient and that would be the best case scenario health wise ... OR ... IF the Doctors think she needs further inpatient help, she will be kept longer - Either way, Brit's Dad Jamie gets final say because he was awareded temporary Legal Control over Britney and her Assets.
Based on that, inpatient or outpatient -Britney isn't going to be going ANYWHERE unaccompanied by the private Security Daddy will arrange for her until Britney gains back her health and is able to control herself and her own finances.
Luckily, all the evdents leading up to that will take time and by then Britney will be well into a maintenance program that effectively should leave Britney realizing her emotion state she is stabelized - especially if she is sleeping regularly again!
It is a win-win situation because Brit will NOT gain any control over the Situation until she is health again - and that is good news for all including her boys who need to see their Mommy as much as she needs to see them!

After reading this story I am a bit confused. As far as my understanding from a press release talked about on E! Radio on Sirius last night (as well as CNN), Jamie Spears is the conservator until another court hearing takes place on Monday. This means that during the conservatorship he holds over Britney, she can be forced to stay in the hospital until after that hearing takes place. In order for the court order to be changed, the psychiatrists that are currently treating her at UCLA Medical Center MUST testify that she is no longer a danger to herself or others and whether the 5150 hold should be escalated to a 5250 hold. The court getting involved makes it not so easy for her to just waltz outta the psych unit. Also, don't forget that the court also put a 22 day restraining order against Osama Lutfi that hold whether or not she is released. I fear that X17 is misinformed and possibly making up stories. The worst thing that could happen right now is for her to be released from he hospital. I think something very bad will happen if she is. She needs to get help and get back to being the Britney we (her fans) love.

Adding security and removing the paps from the parking area is not preparing for release. A 72 hour hold is measured in hours; not days. Say the 72 hour hold began on Thursday, January 31, 2008 at 2:00 a.m.. Then the 72 hour hold would expire at 2:00 a.m., Sunday, February 3rd. Obviously the courts are not open. What happens next is she is evaluated by at least two doctors who are County of LA employees or under contract to the County of LA. Generally, these are two psychiatrists, but one could be a clinical psychologist. There is a minimum of 5 years of experience dealing with psychiatric cases required. If they agree to certify her for another 14 days, they both sign a "Notice of Certification" and it is served on Britney. This will be done prior to the expiration of the 72 hours. Then, Britney has a right to request a Writ of Habeas Corpus -- a written direction from a court to the psychiatric facility release her body. The hearing for this writ must be scheduled within 4 days (days this time, not hours) from the time the "Notice of Certification" is served on Britney. So, say they serve the "Notice of Certification" on Saturday, February 2nd after the doctors make their rounds. It goes to Britney and the Patient's Rights Advocate. The Patient's Rights Advocate automatically requests a hearing. It goes to the Public Defender's Office (but Britney can choose her own lawyer instead). Then, once court opens on Monday morning, the Court Clerk files the Petition for the Writ of Habeas Corpus (received from the Patient's Rights Advocate) and schedules the hearing. Sometimes these hearings are on Tuesdays. LA County may use a hearing officer procedure. The scheduling time of 4 days is written in the California statutes so it doesn't change whether LA County is going to use a hearing officer procedure or a Court proceeding before a Judge. Unless the doctors decide to release her, nothing will happen to schedule a hearing until Monday morning. That hearing is a closed hearing and Britney is entitled to attend unless HER attorney waives her attendance.

First of all, Brit is NOT a drug addict! She was named a frequent user of drugs and alcohol and then PASSED every drug tet she has been given. yes, she may have had access to system cleansers, BUT on the night of her stand-off she would NOT have had access to one and YET she PASSED her drug test.
Second, she is ill, she has a VERY SERIOUS medical condition which clouds her judgment on things she does and HER OWN HEALTH. With her condition she feels she is normal and the things she does is normal. Third, it would be nice for them to make her stay, but it would be nicer if she would be given the choice and chose to stay, however, she might not see herself in need of help. My worry with her being forced to stay is that when she gets out she will rebel and end up worse then she is now! Another hearing is scheduled with the court on Monday, regarding permanent conservatorship. Not all documents were available for the judge to grant permanent conservatorship on Thursday, therefore the judge is reviewing all medical documents over the weekend; and will more than likely grant a permanent order to Britney's father, and estate lawyer, until Britney gets mentally well. If a permanent conservatorship is granted on Monday, all medical/mental health care decisions will be made by Britney's father, NOT Britney. If her father is granted medical conversatorship, he can make the decision to have Britney involuntary committed.
I seriously doubt she'll be released today.
Using a picture of her eyes half-closed while blinking really isn't very convincing that she's on drugs. You guys will do anything to make more out of a story.

If the 2 docs agree to release her she will be out by tonight. Considering they were going to detox first and then evaluate her mental condition, it is unlikely they could observe her mental condition in a sober state long enough to make firm diagnosis. So, it is likely since she was doing the British personna as of last night, that they will certify her for a 14 day hold. If the 2 docs disagree, the mental health director (if he/she is a psychiatrist) makes the cut (if not a psychiatrist, then a psychiatrist the director appoints). Not likely 2 docs will agree to release. They haven't had enough time to observe a sober Britney. Therefore, IMHO, nothing will happen regarding actual release until Monday at the earliest or Wednesday at the latest. However, if a hearing officer continues the 14 day hold, then we're talking February 17th or 18th for a release unless she gets better earlier.

RECAP -- Adding security and removing the paps from the parking area is not preparing for release. A 72 hour hold is measured in hours; not days. Say the 72 hour hold began on Thursday, January 31, 2008 at 2:00 a.m.. Then the 72 hour hold would expire at 2:00 a.m., Sunday, February 3rd. Obviously the courts are not open. What happens next is she is evaluated by at least two doctors who are County of LA employees or under contract to the County of LA. Generally, these are two psychiatrists, but one could be a clinical psychologist. There is a minimum of 5 years of experience dealing with psychiatric cases required. If they agree to certify her for another 14 days, they both sign a "Notice of Certification" and it is served on Britney. This will be done prior to the expiration of the 72 hours. Then, Britney has a right to request a Writ of Habeas Corpus -- a written direction from a court to the psychiatric facility release her body. The hearing for this writ must be scheduled within 4 days (days this time, not hours) from the time the "Notice of Certification" is served on Britney. So, say they serve the "Notice of Certification" on Saturday, February 2nd after the doctors make their rounds. It goes to Britney and the Patient's Rights Advocate. The Patient's Rights Advocate automatically requests a hearing. It goes to the Public Defender's Office (but Britney can choose her own lawyer instead). Then, once court opens on Monday morning, the Court Clerk files the Petition for the Writ of Habeas Corpus (received from the Patient's Rights Advocate) and schedules the hearing. Sometimes these hearings are on Tuesdays. LA County may use a hearing officer procedure. The scheduling time of 4 days is written in the California statutes so it doesn't change whether LA County is going to use a hearing officer procedure or a Court proceeding before a Judge. Unless the doctors decide to release her, nothing will happen to schedule a hearing until Monday morning. That hearing is a closed hearing and Britney is entitled to attend unless HER attorney waives her attendance.

Just after midnight tonight will mark the end of the 72-hour initial hold period of the 5150 hold Britney has been under. So what will happen next?
The Medical Center security has been beefed up since yesterday -- there are guards at the entrance to the building and the paparazzi have been forced out of the parking area.
Doctors were expected to evaluate Britney's condition today and to begin to formulate their recommendation to the court as to whether her 5150 hold should be extended or whether Britney should be given the right to make her own decision as to her treatment -- meaning she could choose to leave the hospital and NOT be treated.

Because I can't prevent people from reading these sites, so I'm using it to help people understand what happens. I'm sharing professional knowledge about the system through this vehicle. unfortunalty i believe she will be as good as gone if they release her early. she's not ready i hope they think about her ,her family(boys) before they let her go. If its true that she was classified as gravely disabled then I dont see how she can get out a day later. On the other hand, it is very difficult for the state to force someone to stay against their will. For her own sake, I hope that she stays and gets the help that she needs. Her father AND a well known conservatore/estate lawyer are in joint control of her finances and estate at this moment, as appointed by the court. At a hearing on Monday, the court will make further rulings. Her father is not in complete control of her estate. He himself requested that an outside party be appointed in joint conservatorship, and he researched and found probably the best lawyer in the area who is an expert in this field.
At Monday's hearing, the doctors can present medical evidence if they feel she should be held longer, against her will, for treatment. The doctors will present their evidence and the court will decide. Of course, she can voluntarily remain in the hospital, but that probably won't happen, unless she makes some major improvement and becomes well enough to realize that she might be safer in the hospital.
I feel she is not safe outside the hospital because of Sam, Adnan, and any others like him.
It is to Sam's advantage to keep her functional enough to appear to be carrying on her regular life, such as getting a video done, but it is also to his advantage to keep her less than well, at her best, because he will never retain control over her once she fully recovers.
No one has to like Britney Spears, the artist. But there is Britney Spears The person. people can dislike her music, but no one should take this oppertunity to cast judgment on brit as a person. Bi-Polar, MPD, drug addict... all these are serious and should be handled in private. The sad thing is is the people who are saying bad things will someday be touched with one of these problems through out their lifetime, and will then hopefully look differently upon the things they said here.

I highly doubt she will be released but if for any insane reason she gets released, she will have no othe rchoice but to get help due to her money being cut off from her. A classic move that is always recommended when there is an intervention. It usually is a backup so someone can not run from help.

Read up on what this type of conservatorship means in the state of California. Dad and Mom did not bring the paperwork to court to ask for control as far as psychatric care goes. Odd, huh? They made sure they got temporary control over the cash and assets and are now claiming a burglary at her residence that occurred after her hospitalization, but just could not be bothered with the appropriate medical paperwork. Hell, her parents have only been to her house when she has her blowouts. That would be once for Dad and once for Mom. The Los Angeles Police Department was called to the Beverly Hills home of Britney Spears Friday after her parents discovered valuable possessions belonging to the singer were missing, a source close to the singer tells Usmagazine.com.
After Spears' father Jamie won legal control over his daughter at an emergency hearing Friday, he and ex-wife Lynne returned to the house "shocked" to find valuable items of their daughter's "had been stolen," the source says.
They called police and filed a report.
Spears' parents believe that items were taken after their daughter was taken to the UCLA Medical Center early Thursday morning.
Los Angeles Police officer Alex Martinez confirmed to Us that police had responded to a call at Spears' house, but did not know what had transpired.
"The report is being processed through our system," he said. "We do not have access to it."
At Friday's hearing, Jamie won temporary legal control over his daughter. He also has full control of her residence and can legally remove anyone who is staying there until the next hearing, on Monday.
A 21-day civil harassment restraining order was also granted against Sam Lutfi, who has been accusing Jamie and Lynne of poor parenting.

No it is not odd that Mr. Spears did not seek to make psychiatric decisions in the conservatorship. He cannot do that. The legal authority lies with the Director of Mental Health for Los Angeles County. The County of Los Angeles is holding her and acting through their Director of Mental Health. The doctors do not make a "recommendation" to the court or a commissioner. The statutes give the Director of Mental Health the authority to hold her. If she is certified for an additional 14 days of involuntary treatment, then Britney will have to bring a legal action -- separate from the conservatorship proceeding and separate from the family law custody case -- a whole new case. It is a Petition for a Writ of Habeas Corpus and it is put on the MENTAL HEALTH calandar in court -- not the probate court which is handling her conservatorship or in the Family Law department. Britney's lawyers would have the burden of proving by a preponderance of the evidence that she is NOT gravely disabled or a danger to self or others due to a mental disorder. They can ask questions of the doctors. The County's lawyers will also have the right to ask questions. The hearing will be closed. The hearing could be Monday, but more likely will be Tuesday or Wednesday in Probate Court, but on the Mental Health calendar -- unless LA uses a hearing officer who may go to the psychiatric facility to hold the hearing.
It's not surprising. No good doctor or hospital would release her after 3 days. That's ridiculous, but even 2 weeks will not be long enough. This will be a long process, and a life long battle.

The contemporary work by choreographer Hubert Essakow follows Spears as she deals with paparazzi and shaves her head. It ends with Spears being carried off on a stretcher.
"It will be performed ... for one night only with four other short pieces of work," said Craig Titley, director of marketing at the Rambert Dance Company. "Meltdown," part of the company's "Season of New Choreography," was to be performed Friday at London's Queen Elizabeth Hall.
Essakow told the British Broadcasting Corp. that Spears' story is "a modern day tragedy."

It's not a done deal, but expect that sometime tonight, papers will be signed at UCLA extending Britney Spears' stay at the psych ward -- by 14 days.
It's an internal process -- done without a court order. But we're told it will indeed happen, and that's not surprising given her mental health. As we first reported, Britney's been diagnosed with severe bipolar disorder.
The ward Britney is in is considered one of the best in the nation for the treatment she is receiving.
Her psychiatrist and Britney or her conservator will appear before a judge and the judge will decide if the 14 day hold is justified. The hearing can be held at the hospital or in a ourtroom. Check the Welfare & Institution Code for the exact details. Her hold is now a 5250. She also has free assistance from a Patient's Rights Advocate provided by LA County. She cannot be put on the 14 day without a hearing.
C'mon! They reported this 9:47AM today and Britney isn't out yet.
She will not be released tonight.

"The best place for Britney right now is where she is," the source said. "The longer she remains there, the better it is for her."
News that Spears may be prolonging her stay in the hospital's psych ward, where she has been undergoing a battery of mental evaluations since voluntarily checking into the facility in the early-morning hours Thursday, comes in the wake of confirmation that even if she's allowed to leave the hospital, she won't get far.
E! News has confirmed that during the emergency Friday afternoon hearing, in which the singer's father, Jamie Spears, and attorney Andrew Wallete were appointed temporary coconservatorship over decisions pertaining to the Blackout singer's estate and a restraining order was granted on behalf of Spears against manager-pal Sam Lutfi, court commissioner Reva Goetz said a free Spears had the potential to be either a "flight or kidnapping risk."
While neither Goetz nor attorneys for Spears mentioned in the hearing who they feared posed the possible risk of facilitating either a flight or kidnap situation, the source told E! News the Spears family was taking great precautions to ensure their daughter's safety.
"Britney will now be provided adequate security. She had been convinced in the past to do away with personal security by certain people in her life, and that was very dangerous. It was a possibly deadly situation."
The source also confirmed that the amped-up security measures were particularly in response to the kidnap risk, saying the real danger lay in what may happen if Spears leaves UCLA Medical Center without being in the proper state of mind, adding, "Should she be released too early, hypothetically someone could try to take her away."
As for how Spears is holding up in the hospital, the source told E! News the pop star was "ill and vulnerable" and that the family hoped she would remain in treatment as long as possible so as to prevent "another Cedars debacle."
Accusations roundly arose following Spears' previous hospitalization, which took place on Jan. 3 at Cedars-Sinai Medical Center, that the singer was prematurely released.
"This girl is getting the help she needs," the source said, while declining to state the singer's exact diagnosis. "It is very sad that this is even necessary."
Another sad yet apparently necessary action was taken Friday, when the Spears family went to court, something they were apparently loath to do.
"Everything has been chaos," the source told E! News, adding that Lynne and Jamie Spears were "together on everything."
"This was done very reluctantly, but it had to be done because of what has been done in terms of endangering her property, her health and her estate…They did not want to jeopardize her future as a mother. They wanted to make sure they were protecting this very vulnerable person and making sure she is safe. This is all very agonizing for the parents."
Slightly less agonizing, no doubt, was the decision to seek—and receive—a restraining order against Lutfi.
"There was significant and dangerous conduct that he exhibited," the source said. "It was not even a close call for the judge."
The order, which will be in effect for 22 days, effectively bars Lutfi from either going to Spears' home or visiting her at the hospital, for however long she remains there.
In what appears to be part of the Spears' family's attempt to completely extricate Lutfi from their daughter's life, a source close to the family told E! News that Britney's future with the Trope and Trope law firm, which has been representing the singer in her ongoing custody battle with Kevin Federline, is "uncertain."
In the past, the law firm has worked closely with Lutfi and counted him as an ally. A source previously confirmed to E! News that the manager was the go-between for all legal dealings between Spears and her attorneys.
Meanwhile, Trope and Trope, along with Federline's attorney, Mark Vincent Kaplan, are due back in a separate Los Angeles courtroom Monday, where a previously scheduled hearing in the custody battle is expected to take place.

The laws are strange, that her parents can put restraining orders on her friends. It's good that they can lock her house, but i think the doctors should deside wich people are allowed to visit and the patient should be able to say no to them she/he doesn't want to meet. That's the way where I live.

I agree. There have been some interesting articles and links posted here. If we depended on X17, we wouldn't know anything. They are too biased when it comes to Osama. The Chicago Sun Times article was really interesing and full of facts, not lies. It was refreshing to me to read some truth.

The reason Britney Spears can NOT see her chcildren is not to punish HER, but to protect those two kids from her erratic and frightening behavior andto keep them from any potential harm she may wittingly or unwittingly cause them to suffer.
Many's the case in the news in which we've heard that mothers of fathers who love their kids do things to them, even kill them, out of some delusional belief they are showing love or saving them.
The laws aren't "strange". They make perfect sense. In this case there are three people who need protection. Two of them, the boys, need protection from their obviously ill mother. The Mother, britney, needs protection from the likes of Lutfi and Ghalib who set out to exploit and benefit from Britney an her vast wealth. Ghalib's been reported as maneuvering this for years.
You must be either young yourself, or not yet a parent, or both not to understand the parents' position and how the laws work.
James Spears is in a co-conservatorship with Britney's business manager.
The courts would OT have done any of this, including the matter relative to her children, unless there was a TON of clear, extreme and present reasons for doing so.
Britney Spears is in the right place now with the right people, real adults, not fellow arrested developed adult-wannabes, overseeing her protection and welfare.
Despite what so many of the youthful, immature, inexperienced fans think, the adults, despite their flaws know better than you, Britney, Lutfi or Ghalib what needs to be done in this case.
Relax and let the adults now handle things to help get Britney back to health.

Therefore, her father, acting under his power as Britney's conservator, could petition for a restraining order against Mr. Lutfi. The conservatorship would have been granted first and followed by the motion for the restraining order.

...well, they are the next of kin and the best people to oversee these things. Somebody has to have it. The doctors only deal with the medical end of things and there has to be someone who can make decisions with the doctors about those critical things.
As for the other things. I think you and so many others are greatly brainwashed by the Lutfi influenced Britney camp.
Look, it is likely she had the typical dysfunctional family life most people around the world live through. We all have skeletons in our family closets. Some ARE bad, but most are just the usual run-of-the-mill things like fights, divorces, alcohol or substance abuse. From everything I've read of brit's childhood it was actually no worse or better than most people's. In fact, one's got to give real props to Lynne for guiding her daughter along to the point where she's a household name and has vast wealth and opportunities.
Were there downsides to it all? Sure, but whose family experience DIDN'T have downsides? Was Lynne or James the perfect mother and father? No. But again, whose is? Are they as bad as, for some immature, soap opera-drama reason the young, inexperienced fans of Britney think they are? Absolutely not. They were just your average American parents who just tried to get along in life.
I would dare say my childhood likely was far worse, and you'd probably agree if you knew my childhood circumstances. Perhaps your childhood was no picnic either. But ya know what? Believe it or not, that's pretty normal across the planet. You think you Britters had it rougher than the children in Ethiopia, Zimbabwe, Russia, Asia, Phillipines, Mexico, Latin & South Americas where they are malnourished, exploited for labor, used as sex slaves/raped, beaten, murdered by the millions?
No, my friend, Britney, despite the misinformation had a pretty average childhood as it goes here in America. She's lucky in that way.
What many of you work to deny is that much of Britney's problems lie at Britney's feet. Perhaps she does have a bi-polar condition. But that isn't a problem if one is taking in proper nutritive food and drink, getting good heathy exercise, getting decent regulated sleep and in many cases, not all, taking the necessary medication.
We've all read the information. She hasn't for a long time, long before even meeting Kevin Federline and having those two boys, been eating and drinking good healthy foods and drink, getting good exercise, the right type of sleep or taking her medication.
She HAS been abusing to a very dangerous degree laxatives which, as she's been using them(to lose weight), depeletes the body of essential nutrients and dehydrates the body. She has been, according to all reports, abusing a drug called Adderall. She has been overdosing on drinks such as Red Bull, Fraps and alcohol. Likely she has been also doing other types of drugs as listed by her 55 hour husband Jason Alexander such as Extacy and crystal meth.
All this is in vain and dangerous attempts to "self-medicate". This, too, is normal behavior for someone who is not only "bi-polar" but has other mental issues.
Don't buy the Lutfi type smearing againstBritney's parents. They DO love and care about her. Just as, likely, your parents do you, even though sometimes you probably think they don't.
I'm a parent. My kids are now in their very early twenties and they've said to me a few times that they think sometimes I don't love and care about them. That happens when I don't agree with them on certain things (not that I'm always right, mind you. But I knwo a few things they don't about life) and refuse to enable them in things or situations I don't think is good for them.
But they are "adults' now, at least according to te law. And they have to make their way as best as possible. And when they fall, and they have, as I did at their age (and still do now and then, but not like when I was a youngin'), I will be there to help in any way I can. but I won't excuse them nor enable them. They must take responsibility for their actions. Something Brityney hasn't had to do, which is a HUGE part of the problem in her case as she isn't learning how to be a responsible adult.
If either of my two kids were going through what Britney is, you can bet I'd be doing much the same as her parents are.
Right now, Britney Spears' life is in the best position it's been in all tese many many months.
Relax, as long as the adults, her parents, the courts, the doctors, etc, are allowed to help her and get her to a point where she can herself recognize she needs help and begins to assist in her recovery, which will take YEARS, then she has a very real possibilty of pulling through all this and coming out the other side in good shape.
I know this was long, but wha you asked couldn't be put in just a few simple words.

What a pitty it would be if Britney is let out of the hospital with out the treatment she needs to get well.
