Dina Lohan Says Lindsay Cried After Seeing The E-Trade Super Bowl Commercial

Lindsay Lohan was "extremely upset" and "sobbing uncontrollably" after she saw the now infamous E-Trade Super Bowl commercial about a milkaholic, boyfriend-stealing baby named Lindsay.

As you know, Lindsay is suing the company for $100 million for using her name without permission (her lawyer argues that she has single name recognition like Madonna), and mom Dina tells the NY Post, "They're little babies doing this, mocking another child who's just trying to survive Hollywood, basically. I'm just basically glad I took a stand. I'm not going to let them do this to us anymore."

So basically, what Dina is saying is that 23-year-old Lindsay is still a child? Basically...

Was Lindsay Lohan the first thing you thought of when you saw this commercial?

My cousin is clean and has been for years she made a mistake everyone does but shes a change woman and is trying to live a normal life. People her age do these kind of things all the tiem its just my cousins in the spotlight and has many fans looking up to her. It was very hurtful for my family to see this. This is crap, of COURSE that commercial was about Lindsay LOHAN. How many red haired babies did etrade have before this commercial? How many of their babies had names before this commercial? How many people hit twitter stating that this commercial was about Lindsay Lohan when it aired? This is NOT any random name and random baby. E Trade wanted buzz and knew they could get it by capitalizing on Lindsay Lohan's alcoholism and reputation and covered their asses by not using her last name. Maybe my niece, Lindsay, could get into some kind of class action lawsuit with Lindsay, along with my babysitter's daughter, Lindsay along with - well, there are around 75,000 Lindsdays in the U.S. right now so there wouldn't be that much to go around.

I'm not on etrade's side. I don't like the baby commercials and I don't find them cute or funny. Just tiresome. That idea is old, similar to a movie that had talking babies featuring Bruce Willis's voice.

Moreover, Lohan admits so much prior emotional distress that she will have a very tough time recovering on that theory. The other three theories all depend on how an ordinary reasonable person would have perceived the comments. Similar to libel, the receiver of the communication must have clearly and unambiguously understood the comment to reference Lohan-and that's just too tenuous. She isn't a household name. Moreover, she herself poked fun at herself on the same subject on Funny or Die. Lastly, she has no real career prospects and cannot show economic harm.

Umm. No. — at least according to a poll by celebrity market researcher E-Poll.

Lohan — former Disney child star, turned member of the “Mean Girls,” then media sensation, before plunging into alcohol and drug abuse and going to rehab, from which she emerged to a troubled acting career and then flopped in the world of fashion, all before she turns 24 years old this year — has sued E*Trade Financial Corp, seeking $100 million for an advertisement that Lohan claims wrongly uses her “likeness, name, characterization, and personality” without permission, violating her right of privacy. Importantly, the ad uses only a first name, Lindsay, and of course there are millions of Lindsay’s in the world. Still, a lawyer for Lohan told the New York Post that the Hollywood actress has the same “single-name” recognition as celebrities like Oprah Winfrey and Madonna. Really?

E-Poll, which makes a business out of asking questions like these and selling that information to companies looking for details about celebrity and pop culture, has come up with some different results. E-Poll recently asked a similar question of people and here’s what it found. In the name awareness category, Lindsay Lohan had a 77 percent rating to Oprah Winfrey’s 89 percent and Madonna’s 91 percent. Not bad, Lindsay LOHAN, but not quite the same — and not on a single name. E-Poll, by the way, is in no way affiliated with E*Trade. The two companies just share a first letter. The timing is odd. Dina is talking, Michael has gone silent and Lindsay hasn't said a word about it. The attorney who filed the story isn't talking. Lindsay's publicist is on haitus. We’ve all seen and love the E-trade commercials. During the Super Bowl, we witnessed and laughed at the “Milkaholic” commercial where the E-trade baby’s girlfriend asks if “that milkaholic Lindsay wasn’t over?” Apparently, Lindsay Lohan thinks this “Lindsay” is a slick attempt to make fun of her, so she’s suing E-trade for $100 million. It’s possible that E-trade was making reference to Lohan, but it’s more likely that the commercial would rather poke fun at a celebrity. Lindsay just needs to watch the commercial again. She made a simple mistake, but she shouldn’t feel bad because I made the same mistake of thinking the commercial said “anorexic cokehead” instead of “milkaholic” the first time I saw it, too.

Actress Lindsay Lohan confirmed to WWD that she is no longer part of Ungaro's design team. At Monday afternoon's Kenzo show, Lohan was asked why she hadn't been at Ungaro earlier that morning.

She replied: "Because I don't work for them anymore." Prompted for more specifics, she noted, "There's legal things going on; I can't really discuss it."

After hiring Lohan last year, former Ungaro CEO and President Mounir Moufarrige told WWD, "Designer-led fashion is likely not to be enough. It's a slow process going the traditional route." Moufarrige stepped down last December and declined to comment on Lohan and Ungaro when reached on Monday.

APLindsay Lohan A quick look back at her Twitter page shows that Ms. Lohan was watching the Feb. 7 Super Bowl broadcast, and its commercials, closely. She tweeted with some shock during the game: "Did that just happen? On that commercial? Or am I wrong? 5:44 PM Feb 7th via UberTwitter."

It appears that tweet was referring to the E-Trade spot "Girlfriend" -- one of two commercials the repeat Super Bowl advertiser had in the game this year -- in which we see a baby talking to his girlfriend about the importance of building a diversified portfolio, while she fumes wondering what else he's been up to. The girl baby says: "And that milkoholic Lindsay wasn't over?"

The style of the ad is much like ones before it in the "Talking Babies" series, in which the babies say something snarky and off-color. (Incidentally, Bob Garfield gave the commercial high marks.)

She told the New York Post: "Many celebrities are known by one name only, and E-Trade is using that knowledge to profit. ... They used the name Lindsay." She went on to say: "They're using her name as a parody of her life. Why didn't they use the name Susan? This is a subliminal message. Everybody's talking about it and saying it's Lindsay Lohan."

Indeed, a lot of people were talking about it on Twitter in the aftermath of the spot's airing -- with many egging Ms. Lohan on to file a lawsuit against E-Trade. Wrote someone named Ryan Curtis: "@lindsaylohan I would sue if I was you," and later saying "@lindsaylohan I really think you should look into it. It wasn't funny and rude." She replied back to several of the comments, but seemed to take it in stride, if not be amused by it. Wrote Ms. Lohan to @bigbillybmoney "hahahaha vitamin D never tasted so good!" Another person named Alex Rodil joked with Lohan: "U darn milkoholic! HeHe" and attached this photo to the tweet.

Whether her suit holds up in court remains to be seen; she's seeking an injunction to stop airing the ads and $100 million in damages. But it's pretty surprising that before filing the suit she didn't delete her Twitter comments.

E-Trade's agency, Grey, and CBS, which broadcast the Super Bowl and sold the air time, are not believed to be named in the suit.

E-Trade did not immediately return a request for comment.

Parody is protected speech. Milk-a-holic isn’t defamatory. According to E-Poll, she doesn’t have a mononymous name. Her image wasn’t used in the commercial. She wasn’t upset when she tweeted after seeing the commercial. In fact, she joked about it and wrote about making Got Milk? 2.0 (no chance). The lawsuit’s excessive claim for damages looks like they are seeking an out of court settlement. I hope E-Trade doesn't yield to this frivolous lawsuit. If it goes to trial, E-Trades’ lawyers will show the jury her tweets and she won’t get zip. I hope E-Trade counter sues for legal costs.

Good question. I checked the ruling. The U.S. Supreme Court issued a unanimous 8-0 decision in Hustler Magazine, Inc. v. Falwell. If her lawyer is aware of the precedent, it makes the E-Trade lawsuit look even more pathetic.

Or they they don't care and are willing to lose a claim to generate some media attention to the firm. This does happen from time to time. Even a substantially prevailing defendant may not necessarily recover attorneys fees and costs in some cases-so it could be a win-win situation for them. Believe me, there is no merit to this baseless claim of hers. I cannot get into all the details. But for a number of legal and practical reasons, she will not recover, unless they shake her loose with a nominal settlement to rid themselves of her-don't worry, Lindsay is accustomed to being given the brush.

11:53, I think the E-Trade suit enables her to update the resume with frivilous lawsuits just as it stands; however, I can't say for sure in regards to any potential litigation concerning Ungaro. In breach of contract, Sluthan can only be made whole for the value of the contract price, if there is a substantial breach; however, is it that Lohan breached???? Sounds like this relates back to the Patrick thing and her not being able to perform as required under the contract ;) Goodnight to you!

Schonheit, it was noteworthy that Unagaro removed Mounir Moufarrige as CEO but did not simultaneously terminate her contract. I agree this may have something to do with Patrick and his undisputed claim on the 6126 designs and sketches. If her Ungaro contract stipulated specific “artistic” (written tongue-in-cheek) contributions she is unable to make, it would be grounds for terminating her contract.

Dina's damaging Lindsay's already compromised reputation here. There's a very intelligent article written (on the net) about the whole dubious nature surrounding the origin of the person masterminding this suit. It doesn't point to Lindsay Lohan. It more points to someone in the New York area for very good reasons. And who said "I took a stand"? This, so far, is a PR nightmare that goes beyond the usual tabloid world, and the association is with Lindsay, not who actually may be behind this sham. For the record, has Lindsay made any public statements, including twitter, about this suit?

As for eTrade, the original baby's name was Deborah. It could have stayed Deborah since most people think having the name Lindsay doesn't matter. I say it does, and eTrade deliberately but slyly used the name Lindsay for enough people to make a connection to Lindsay Lohan. It was a superbowl commercial after all.

The lawyer does have a point. If a question was asked of people in the world, name someone famous who has the first name of Lindsay, at the time of the Superbowl (not Olympics), I think Lindsay Lohan would get the most hits. I'm pretty confident that it would be so. That's where the subliminal message comes in. While people may not have made an immediate conscious connection to Lindsay Lohan, the appearance of the baby, something with the term "oholic" in it, does send a subliminal message to the brain that links to Lindsay Lohan. That is a reasonable argument. How much merit it has legally, I don't know. Maybe not much but an Esquire may know something I don't.

Lindsay has to get tougher. She's no mean girl, she's fragile. She speaks when she shouldn't and doesn't speak when she should. She should first of all tell people never speculate as to her motivations or what she thinks. Do not put words in her effing mouth. People don't know her yet say this and that about her like it is real. It's not. It's public perception that may have nothing to do with reality. And she needs to say something or have her representative give her side of what's going on in this lawsuit. By remaining silent, people's perceptions of her become reality and she fades behind stronger personalities like her mother. I think if Ali ever gets into the public arena in her own rite the media/tabloids won't be able to pull the same crap they do with Lindsay. I think Ali will assert herself and tell people to STFU about who she is and what she thinks.

The Super Bowl occurred in February 2010. In December (three months before the lawsuit) Grey's chief creative officer, Tor Myrhen was interviewed by Esquire.

A reporter sat in on early meetings with the Grey Group, E-Trade's advertising firm, for what they thought was "a harmless little inside look" at the "milk-a-holic" ad's creative process — one that now is shedding more light on the case.

According to the writer Joshua David Stein, documents and interview notes show that the character's name changed from Deborah to Lindsay, but the celebrity parallel was dismissed early on. In December (the name was changed in September), Stein asked Grey's chief creative officer, Tor Myrhen, whether "Lindsay" was a reference to Lohan. "Not at all. I don't think we even thought of it at the time," he said.

In this case, Regent University professor of law Jim Duane is extremely skeptical that Lohan has a shot at winning in court. First, he says, she would need to convince the court that she is "the Lindsay" people are speaking about whenever they use the name, unlikely since the name is not distinctive.

For the past 10 years, the name “Lindsay” has been one of the top 400 most popular names for baby girls, according to the Social Security Administration.

Lohan would also need to prove that the ad implied her endorsement and was not simply a parody, which is protected by law.

In 2008, rapper 50 cent sued Taco Bell, owned by Yum! Brands ( YUM - news - people ), after the fast food company issued a press release promoting its low price menu selections which stated the rapper had changed his name to “89 cent” or “99 cent.” The suit was settled in 2009.

Lohan’s Twitter record was preserved and published. If this farce goes to trial, her statements are admissible evidence. Her nonchalant reaction proves she did not suffer damages. Her mother‘s characterization is inconsistent with her daughter’s contemporaneous Twitter reaction to the commercial. It is a frivolous lawsuit brought by an irreparably damaged former actress and failed artistic director.
