More legal woes for Lilo!

Lindsay Lohan has been hit with a countersuit for $5 million by D.N.A.M. Apparel Industries, the manufacturer behind her 6126 clothing line, reports TMZ. Lindsay filed a lawsuit against the company claiming they failed to pay her for a massive licensing fee, and she's seeking $1.1 million in damages.

However, now D.N.A.M. is firing back at the 26-year-old starlet claiming she's the reason their business deal fell apart. According to legal docs, D.N.A.M. says they did everything they could to sell the 6126 brand to high-end third party retailers, but by mid-2010, no one wanted to buy the apparel because of Lindsay's troubles with rehab and the law.

D.N.A.M. added that Lindsay's "drug-addled image" destroyed 6126's reputation, and rendered the clothing line completely unsellable. D.N.A.M. is also suing for breach of contract and fraud, demanding at least $5 million in damages.

Lindsay's attorney (well, one of them!) Perry C. Wander said in a statement, "The license agreement does not have a morals clause that allows the company to suspend payment for any behavior. The contract is not in LL name thus she cannot be held personally liable. The cross claim is therefore frivolous and totally without merit and will be defended vigorously."

Lindsay Lohan will NOT be allowed to leave the Betty Ford Center in Rancho Mirage, California, where she is currently serving a court-mandated 90-day sentence for a probation violation.

"It is understood by the Betty Ford Center that your client is to remain on the premises for the duration of her 90-day stay in treatment," reads a letter filed with the Los Angeles Superior Court by Lohan's newly re-hired attorney Shawn Holley. While this isn't the rehab facility previously agreed upon by the court, Judge James Dabney approved of it yesterday, according to the Los Angeles Times.

The letter notes that Lohan will be treated by a team of experts, including a physician, a nurse, a psychologist, a case manager, a spiritual care counselor, a family counselor, a dietician, a fitness trainer and a chemical dependency technician. Lilo will be kept on a strict schedule that starts around 6am and ending at 9pm, and patients are forbidden from having cell phones, and they are randomly drug tested.

Lohan was treated at Betty Ford in late 2010, but she never completed her stay. Lohan got into an altercation with a staffer who caught the actress trying to sneak out, and it later came out the Lohan "reeked" of alcohol at the time of the incident.

However, the facility noted that they cannot hold patients against their will nor can they prevent them from running away, so it's ultimately Lilo's decision to serve her full sentence ... or wind up behind bars.

Lindsay Lohan sat down with CNN correspondent Piers Morgan for an interview for UK's Daily Mail and she was surprisingly candid, answering Piers' personal questions while she relaxed in her pajamas on the balcony of a New York hotel, chain-smoking.

Morgan jumped right in, asking Linds about her dad Michael and his alcohol and drug abuse. Lindsay told him:

"He won’t change. I just think there comes a point where you just kind of have to accept what it is. Whenever I do try to bring him back into my life, he creates chaos for me and uses it to his advantage. He’s been really good and then really crazy my whole life."

And then Lindsay spoke about drugs, saying she's tried cocaine "maybe four or five times in [her] life,":

"I don’t like it. It reminds me of my dad. I took it four times in a period from about the age of 20 to 23, and I got caught twice." And about the other drugs she's done: "Pot, obviously. And ecstasy. I liked that better than the others (giggles). I didn’t drink on it, so I was just chilling. It’s something that a lot of people experience when they’re in college. I just should have known that being in the public eye, someone was bound to say something or try to make some money off it."

When asked about court-ordered rehab, she said it's a joke:

"I’ve been court-ordered to do it six times. I could write the book on rehab. Constantly sending me to rehab is pointless. The first few times I was court-ordered to rehab it was like a joke, like killing time ... They just asked me the same old questions I’d answered before."

Piers moved onto questions about Lindsay's sexuality. She dated DJ Samantha Ronson for years but she's been with men too, so, the question we all want the answer to ... is Lindsay gay?:

"I like boys ... I like being in a relationship with a guy. But there’s something just different about it with a woman. When I was with Samantha (Ronson), I didn’t want to leave, because I didn’t want to be alone. It was very toxic. And her family controlled anything she did ... I still love her as a person ... I know I’m straight. I have made out with girls before, and I had a relationship with a girl. But I think I needed to experience that and I think I was looking for something different."

Morgan asks if she thinks three months in rehab will help her and she says it's New York that's helped her the most:

"Being in New York has helped me. Just being with my family more, and being able to walk around and have more of a life."

It's probably a good thing she's put her old lawyer in charge!

Lindsay Lohan checked into Betty Ford rehab center late Thursday night after re-hiring her former attorney Shawn Chapman Holley.

The legal powerhouse apparently worked all night to secure a court-approved facility for Lilo, who was in danger of having a warrant issued for her arrest if she did not check-in by midnight.

"Lindsay cut a last minute deal with the D.A. to go to Betty Ford. Shawn Holley helped broker the agreement with [Los Angeles] City Attorney [Terry White] late Thursday night," a source told Radar.

The troubled actress narrowly avoided more legal trouble by complying with court orders. Yesterday, rumors swirled that the Mean Girls star had checked into Morningside Recovery Center in Newport Beach, California, and her former lawyer Mark Heller even told the judge that she had already been admitted to the treatment center, which we later learned was not licensed to treat patients.

Miss Lohan previously underwent a rehab stint at the Palm Springs facility in 2010, where she was involved in a scuffle with staffer Dawn Holland that resulted in the employee's firing.

Hopefully this is the end of her trouble making!

The problems just won't stop for her!

According to TMZ, the possibility of an arrest warrant is very real for Lindsay Lohan if she doesn't report to her rehab facility by tomorrow morning.

It was reported earlier today that the much maligned actress arrived at Morningside Treatment Center in Newport, Calif. today but never got out of her SUV.

If Lohan isn't present at the facility by 6am, prosecutors will head straight to court first thing tomorrow to seek a warrant for her arrest.

Let's hope she gets her act together and quick!

UPDATE:

• Morningside Recovery Center Chief Executive Officer Mary Helen Beatificato maintains they DO have a "license/certification" to provide drug and alcohol treatment, and that the 2012 revocation only affects the facility's ability to provide detox services. Millicent Tidwell, the Acting Deputy Director Over the Licensing and Certification Division at the Department, maintains Morningside can not provide ANY treatment, and is able to provide only a sober living environment, TMZ reports.
• Judge Jim Dabney gave prosecutors a week from Friday to investigate whether Morningside meets the court-ordered requirements for an acceptable rehab facility. But assuming the state has their facts in order and Morningside's license was, in fact, revoked, obviously no judge would approve the facility as satisfying a court-order rehab stay so Lindsay will HAVE to find another place to go -- one with a license.
• Some reports claim Lindsay Lohan checked into Morningside this morning, while others claim the actress is nowhere to be found and has not been seen since 9 A.M., when shoppers claim to have spotted her at a Fry's Electronics in Fountain Valley, California. X17online photographers have been at the facility all day and have yet to see Lilo enter or exit the facility. Looks like Lindsay's MIA.

Lindsay Lohan just checked in to Morningside Recovery in Newport Beach, California, but given that the facility had its license suspended in 2011 and revoked in 2012, we doubt she'll be staying there much longer!

According to a report on the California Department of Alcohol and Drug Programs website, Morningside currently at has no license to provide rehab treatment to patients, and they were sued last year by the family of a young man who died at the facility.

Lohan was supposed to check into the Seafield Center in Westhampton Beach, New York today, but she changed her mind at the last minute and checked in to the Morningside, which was NOT approved by the court. Judge Jim Dabney was fine with Lohan's proof of enrollment for now, but he gave Santa Monica City Attorney Terry White until next Friday to determine whether this is an acceptable location ... if White doesn't sign off on Morningside (and after this, we can't imagine he would), Lohan will be moved.

But where to? And will she try to enroll at another center immediately or just wait until the court forces her to?

This is her new home... at least for the next week!

Lindsay Lohan checked into Morningside Recovery Center in Newport Beach, California this morning to begin her court-ordered rehab stemming from her June 2012 car crash in Santa Monica, in which she pleaded no contest to lying to police and reckless driving.

"Morningside Recovery is dedicated to providing exceptional care, treatment and services for men and women who are chemically dependent or suffering from mental health or co-occurring disorders. We believe every client can recover and learn how to manage mental and emotional stability," the center's mission statement reads.

The facility separates men and women's living quarters, and Lilo will be housed in the Women's Lido Island Homes, which feature quiet bedrooms that open to communal areas for meditation, spiritual reflection, and peer support. According to the website, the home is located "on Lido Isle in the heart of Newport Beach, California. The three separate homes are on a quiet residential street directly across from the bay, with access to the historic Lido district, shopping, and the marina. All necessary amenities, including high speed-internet, are provided."

We're not sure this sounds like lockdown rehab!

In addition, the treatment center states that cell phones, laptop computers, and other electronics are approved once a staff member deems the usage appropriate.

We also know that they allow cigarette smoking, unlike the pre-approved Seafield Center in New York, which she was set to attend before settling on Morningside.

We can't wait to see if the judge approves this place...

Lindsay Lohan checked into Morningside Recovery in Newport Beach, California less than an hour ago and X17online has the first photo of her chauffeur-driven SUV outside the rehab center's intake office, while Lindsay was inside filling out paperwork.

Lohan's attorney Mark Heller appeared at the Airport courthouse just after 8:30am this morning to provide her proof of enrollment at a rehab facility, but since she decided to switch locations at the last minute, she may not get to stay there for the whole 90 days.

Lohan was supposed to check into the Seafield Center in Westhampton Beach, New York today, but after learning that she couldn't smoke at the facility, she hopped on a private plane and headed to California. A furious Santa Monica City Attorney Terry White said he found out about the switch yesterday and called Lohan and her legal team's actions "inappropriate," but Heller fired back and suggested that someone from the court had leaked confidential details of Lohan's deal to the media, which was another reason she wanted to switch facilities.

So what did Judge Jim Dabney have to say about all this? Much to everyone's surprise, he didn't make any mention of Lohan violating her plea deal or being thrown in jail! Instead, Dabney said that the documentation Heller provided seemed to agree with the parameters of her deal and he gave White until next Friday to determine whether this is an acceptable location.

"I don't have any problems with Lohan remaining in the program until we have this issue resolved," Dabney stated. "For now she will remain in the program and then we [will] decide if the program measures up to the requirements [and if it doesn't] then she'll have to move to a different program."

While Dabney seems fine with Lohan's proof of enrollment and the evidence Heller provided, White remarked that had already found three articles "condemning" the facility, so at this point the only thing keeping Lindsay from serving her whole 90-day sentence there is Mr. White. If White determines that the facility does not meet the requirements he initially agreed on, the parties will set a hearing date later this month and Lohan will be moved to another location. Lohan's proof of completion date set for July 31, and as long as she is in compliance, she does not have to be present at that hearing.

But for now ... she's "ensconced" in the center (Heller's words), unpacking her "270 looks" for her three-month stay.
