The opening of this "Pandora's box" is not being limited to just celebrity sites. The ramifications are widespread and are being reported and talked about on just about every kind of site that enables bloggers to defame another. It will give the individual the right to sue or at least "out" the person or persons responsible for libelous statements.

I just read what the other person posted and from what I read the courts made Google tell them the name of the person who wrote defamatory things. Her lawyers tried to stop it and the NY supreme court upheld the ruling. 7:25 is right about it being on other websites. This information is being written about on alot of different, non-entertainment sites. I also saw it about other celebrities besides Linsey Lohan. They are proving that Freedom of Speech is no longer going to protect comments that are libelous just as it's been able to prosecute for slander. Not only is the ACLU all over this, but google itself has said that turning over search records to the department of justice would undermine their reputation. I for one didn't realize this was going on. Had never heard of the Google, Cohen/Port case. After reading what was written about it on CyberSlapp which is maintained by the ACLU I disagree with the ruling. Actually it is pretty widespread, anytime a decision is made by a supreme court it's more than just a judgement for plaintiff. The google case is just the latest in many cases that are currently being tried in the courts. The decision opened the door to what many constitutional scholars and legal pundits are saying is the direction the courts are going on this issue. It is one of many individual cases that could change the laws (certainly here in the U.S.)of what is and isn't protected by the constitution ie, first ammendment on the internet. And to set the record straight, the lawsuit was dropped by Cohen not the courts, google revealed her ip address not her email address... slander is spoken, LIBEL is written. I thank you and welcome your intelligent debate, just don't make it about Lohan because we both know the ramifications are far greater than the pathetic life of just another celebrity.

Some jurisdictions have eliminated the distinction between fact and opinion, and instead hold that any statement that suggests a factual basis can support a cause of action for defamation. It's only a matter of time before legal action is taken. I personally am willing to take the chance that my statements are benign enough not to warrant such action but I am cognizant of the laws and issues surrounding these statements. That's because, according to the U.S. Supreme Court, we all have the same rights and responsibilities under defamation law.

Now, I confess to not being a lawyer. But I am a blogger who would like to stay out of court. I have researched the laws so I know a fair amount of this stuff.

Since legalese can be intimidating, I thought I'd attempt a plain-English overview of the subject. I'd also like to invite those more knowledgeable than me to comment. Keep in mind that this is intended to only to open your eyes.

First, people usually ask the wrong question: "Can a blogger be sued for defamation?" The sad truth is that almost anybody can sue you for almost anything these days. So, don't ask that question; it's dumb. What you want to know is your responsibility under the law, and therefore, how best to protect yourself from successful litigation.

To prove libel, which is the same thing as written defamation, the plaintiff has to prove that the blogger published a false statement of fact about the plaintiff that harmed the plaintiff's reputation.
