Riverside County DA's Office Moves Forward With Lindsay Lohan Betty Ford Investigation

LOHAN011011.jpgThe Riverside County District Attorney's office is still investigating the December 12th incident involving Lindsay Lohan and Betty Ford ex-staffer Dawn Holland, and this morning, we're told a meeting was held "to discuss the next step."

A spokesperson for the DA's office tells X17online:

    "Prosecutors and investigator met this morning to discuss the Lindsay Lohan case, and after review, we've decided more investigation is necessary. We have not decided whether charges will be filed."

The case had been handed over to the Riverside County DA's office by the Palm Desert Police Department. Lindsay's lawyer has not been pleased with the way the department has handled the case. Shawn Chapman Holley had released the following statement:

    "The important, yet limited, investigatory role of the police to gather facts and collect evidence is well-established. The fact that the Palm Desert Police Department went outside this limited role to issue a press statement expressing its opinion about what should happen in Ms. Lohan's case is highly unusual and deeply troubling."

Lindsay is due back in court on February 25 for a routine progress review hearing. The 24-year-old startlet's probation is scheduled to run through August 2011.

This case cannot be proven. If they file charges, Lindsay will be returned to jail without a trial. Once it's actually proven that the case cannot be proven, someone will likely get sued.

If Lindsay is thrown in jail for a probation violation simply because she was charged, only to later be acquitted of the crime at trial, it will open the door for Lindsay to sue Betty Ford for millions. (Others too, but primarily Betty Ford.) And I do mean millions.

Sometimes a D.A. will press charges on a case that is likely too weak to prove in court in hopes of strong-arming the defendant into accepted some sweat heart plea deal. That way, it makes it look like the D.A. "won" a case that was never actually winnable.

But there's no way Lindsay would accept a plea deal here though and also no way prosecutors could win an actual conviction without Holland's cooperation.

This can only end in disaster for all parties involved if the D.A. is stupid enough not to drop it.

Shawn is right. Even TMZ said it's not for the police of Riverside county to conclude what should happen in Lohan's case. Maybe the Riverside police want their 15 minutes of fame. Even Dawn doesn't want Linds prosecuted. They have no proof whatsoever and the only witness sided with Lindsay. There is no case whatsoever.

Now, as others have already mentioned, on with the creepy Lindsay Lohan cyber stalking, because that's what made X17.online so famous in the first place, and clearly what pays the bills around this place.

Just look at X17's most commented stories. They all involved Lindsay Lohan. Every single one of them.

People come here to stalk Lindsay, and X17 gives the people what they want. Its kind of hard in a sense to blame X17 for that, to be honest. X17 is providing a service here, people; albeit a rather shady service.

Radaronline reports that judge Fox has reviewed Lohan's criminal file relating to an alleged assault against the former BF employee, and has determined to take no immediate action against Lindsay. Judge Fox read the report and put it back in Lohan's file. Right now, based on what he has read, he won't be taking any action against Lindsay.

I don't need to read any gossip stuff. We don't really know what happened. There is at least one witness who has come forward and said they saw everything and that both the battery claim and the drinking claim is B.S.

None of that matters though. You cannot win a court conviction for an alleged crime when the supposed victim refuses to support the prosecution. The best you can hope for is to gain a plea deal; a very weak plea deal. At this point, Lindsay has nothing to lose, so I don't think she'd plead out this case.

Look, she'll serve a month in jail, automatically, just for being charged. Since she will have already served the jail time, she might as well just take the case to trial. Especially since she's going to win and she knows it.

I agree completely they won't get a conviction.
Also there is no guarantee that the Judge would violate her just for being charged when the case is sketchy.

If she is put in jail because of this everything will come tumbling down with a major lawsuit being filed against Betty Ford.

She doesn't look too worried. Like Paris, she knew there was nothing to be worried about. Just curious is Lindsay in the same financial bracket as Paris and therefore this is why she has no consequence. Actually Paris went to jail and this time around has to do comm. serv. right? So that makes Lindsay much higher up on the scale than Paris, right? Looking for the answer from a non Lohan affiliate.

Paris actually handled her case quite skillfully and made it go away quickly. LL have been stuck in the miore for 4 years because she has never respected court.

Seriously LL's legal fate will not be decided or deduced from tabloid info. She can of course go to trial, sue, whine and cry the blues to the paps. That will only make her less and less desirable as an actress. What she really need to do is mind her P's and Q's and mend her image.
