BREAKING NEWS - Madonna Sued Over Use Of Material Girl Name For Clothing Line

You may think Madonna has more claim to the name Material Girl than anyone, but apparently a clothing company owned by LA Triumph used the name for their clothing line before Madonna did and they want the Material Girl to cease and desist!
An attorney for LA Triumph, Peter Afrasiabi, told X17online in a statement: "Our client and its predecessor have been continually selling similar clothes in similar retail outlets at similar price points under their Material Girl brand since at least 1997 and Madonna and her new-found company do not have the right to trade in the same space under this brand."
"As a result of their acts, our client faces a risk of being subsumed by Madonna's profile, obvious worldwide notoriety and the massive spending campaign by Madonna, her company and retailers on her behalf," said Chris Arledge, another intellectual property lawyer on the case at One LLP.
The suit claims ads for Madonna's line are "risque" and could confuse the public as to the which Material Girl clothing line the commercials represent. The lawsuit also states Macy's will be added as a defendant upon further discovery.
The filing demands "actual damages" in addition to "profits attributable to their unlawful conduct according to proof to be proved at trial."
No word yet from Madonna's publicist. It will be interesting to see how they fight this one!

Seems like they ripped the title from her in the first place. Madonna is the original "Material Girl"
then she should register "material girl" as a brand, like lindsay should do with "fire crotch" lol
that's easy: UNDRESS HER FINANCIALLY!!
Just because shes been called that in the past does not give her the rights to it. That company has used that name as their own brand for years so Madonna is in the wrong, she should have done her research before naming it to see if that was in use. Shes gonna be in big trouble with this, its copyright law and i'm glad someone is gonna knock her off her high horse.
It's a trashy clothing line anyway...
She came with Material girl first, it was the song title of her hit in 1984, if anything, she could sue them! since they started the brand with MADONNA's NAME 15 years later.
to give an example: theres also a clothing brand called "madonna" in italy. the brand got created by coincidence around the time M got famous in the beginning of the 80s. so they asked M if they could use her name, now that she was famous, and she had no problem with it whatsoever.
Also, you've got to be VERY stupid to believe that you're going to win this case when Madonna came with it first. I also wonder the intelligence or knowledge of the people commenting here. Material Girl isnt just Madonna's nickname, she trademarked it years and years ago. They stand no chance and Madonna is 100% in her right.
The word "Madonna," which has the current dictionary definition as the Virgin Mary or an artistic depiction of the Virgin Mary, is used by others as a trademark, trade name and personal name. Ciccone does not own the trademark. (Curious...who's VERY stupid?)
P.S. The clothing company must prove each of the following:
(i) that the name registered by the respondent is identical or confusingly similar to a trademark or service mark in which the complainant has rights; and,
(ii) that the respondent has no legitimate interests in respect of the name; and,
(iii) that the name has been registered and used in bad faith.
