Charges Filed In Anna Nicole Smith Death

Anna Nicole Smith SternBooking200.jpgLOS ANGELES, California (X17online) - Anna Nicole Smith's former attorney, Howard K. Stern, along with Dr. Sandeep Kapoor and Dr. Khristine Eroshevich were each charged with three felony counts of conspiracy on Thursday.

According to the Associated Press, court documents charge the three with providing the late model/actress with drugs prior to her fatal overdose in 2007.

A spokesperson for the Los Angeles District Attorney's office said that the defendants were charged with eight additional felonies, including obtaining fraudulent prescriptions and unlawfully prescribing a controlled substance.

Attorney General Edmund G. Brown Jr. released the following statement: "These individuals repeatedly and excessively furnished thousands of prescription pills to Anna Nicole Smith, often for no legitimate medical purpose. There is ample evidence that Doctor Eroshevich and Doctor Kapoor violated their ethical obligations as physicians, while Mr. Stern funneled highly addictive drugs to Ms. Smith."

Stern was booked last night shortly after 7pm, and he was released at 9:15pm after posting $20,000 bail.

Prosecutors Say Companion Was Anna Nicole Smith's 'Enabler'


Anna Nicole Smith ANSMITHENABLER200.jpgLOS ANGELES, California (X17online) - California's Attorney General called Anna Nicole Smith's former attorney and boyfriend the "principal enabler" who arranged for two doctors to provide Smith with thousands of pills in the months before her 2007 death.

"This was done knowingly and with tragic consequences," Attorney General Jerry Brown said Friday at press conference.

Stern, along with Drs. Sandeep Kapoor and Khristine Eroshevich were charged Thursday with three felony counts of conspiracy in Los Angeles Superior Court.

In addition to the felony conspiracy charges, Stern and the doctors were also charged with eight other felonies, including obtaining an opiate prescription by fraud, deceit or misrepresentation; obtaining an opiate prescription by giving a false name or address; prescribing, administering or dispensing a controlled substance to an addict; and unlawfully prescribing a controlled substance.

When asked about a motive, Brown said that Stern and the doctors enjoyed a ''psychic gain'' by being with someone rich and famous.

Stern and Kapoor were booked Thursday at the Whittier Police Department and released later that evening after posting $20,000 bond, according to the department's website.

Charges include conspiracy, unlawfully prescribing a controlled substance and prescribing, administering or dispensing a controlled substance to an addict, according to a complaint filed in Los Angeles County courts.

Stern faces six counts and the doctors face seven each, according to the complaint.

Dr. Khristine Eroshevich was expected to surrender Monday.

Arraignment For Pair Accused of Providing Drugs To Anna Nicole

Stern is in a Los Angeles Courtroom this morning where is he is expected to be arraigned on felony charges that he provided Smith with the prescription drugs that eventually lead to her death.

Smith's psychiatrist, Dr. Khristine Eroshevich is also set to be arraigned today on a number of felony counts related to the numerous prescription she provided the former model and reality TV star.

Of the drugs found in the hotel room where Anna Nicole was staying shortly before her overdose, all were prescribed by Eroshevich and eight of them were in Stern's name.

Anna Nicole Was Prescribed "Pharmaceutical Suicide"

annanicolesuicide200.jpgLOS ANGELES, California (X17online) - Recently unsealed court documents in the ongoing Anna Nicole Smith investigation reveal that pharmacists warned the model's internist and psychiatrist, with one claiming her internist was prescribing "pharmaceutical suicide" and refusing to fill prescriptions.

Additionally, the LA Times reports, the newly unsealed docs cite evidence that both doctors, psychiatrist Khristine Eroshevich and internist Sandeep Kapoor, had sexual contact with their patient.

Eroshevich, Kapoor, and Smith's ex-husband and attorney Howard K. Stern, have all pleaded not-guilty to conspiring to illegally provide her with controlled substances.

If convicted, the case could have further implications in the case against Dr. Conrad Murray, Michael Jackson's personal doctor who allegedly administered the fatal dosage of propofol.

Howard K. Stern Shot Up Anna Nicole Smith With Valium

hkstern200.jpg LOS ANGELES, California (X17online) - A former bodyguard for Anna Nicole Smith testified yesterday that he saw the late model's lawyer and boyfriend Howard K. Stern cook a crushed Valium pill in a spoon and draw the liquid into a syringe for her in October of 2006, just four months before she died of drug related causes.

Maurice Brighthaupt told the courtroom that he witnessed Howard injecting Anna Nicole in her Bahamas home shortly after her son Daniel died from a drug overdose.
Brighthaupt said, "I saw him drawing up liquid from the spoon that was being cooked. She couldn't swallow. Anna and Howard felt if they put it in the blood system that it would get into her system quicker."

Brighthaupt said he saw Stern inject Smith with medications "four or five" times in the months leading up to her own death, and he also saw Dr. Khristine Eroshevich deliver chloral hydrate to the Bahamas and inject Smith on at least one occasion.

However, Stern's lawyer sang a different tune. He said, "Prescription medications were never injected by Howard K. Stern. Howard K. Stern loved Anna. He was concerned about Anna's welfare. That's why he wanted to make certain that the doctors prescribed the right medication. He was always with Anna, and it was his hope that Anna would take the medication as she was supposed to to control her pain. She needed to manage her pain."

Larry Birkhead Auctions Off Anna Nicole Smith's Belongings in Vegas

birkhead200.jpgLAS VEGAS, Nevada (X17online) - Larry Birkhead, Anna Nicole Smith's ex, is selling her personal items to make money for their daughter, Dannielynn.

Birkhead will be holding the auction at Planet Hollywood Resort and Casino in Las Vegas on June 26. All the money raised will go to charity as well as a trust fund that has been set up for the young girl.

Judge Denies Request To Dismiss Case Against Anna Nicole Smith's Doctor

smith200.jpgLOS ANGELES, California (X17online) - A judge has decided not to drop two charges against Dr. Sandeep Kapoor, who is accused of obtaining prescription drugs with the use of Anna Nicole Smith's name.

Kapoor, Dr. Khristine Eroshevich and Howard K. Stern have already pleaded not guilty to conspiring to illegally provide sedatives and opiates to Smith. However, the three are not charged with her death.

The next hearing will take place on July 20. As for jury selection, it's slated to begin on August 2.

Anna Nicole Smith was found dead of an accidental overdose back in February 2007.

Anna Nicole Smith's Bodyguard Testifies In Drug Case

smith150.jpgLOS ANGELES, California (X17online) - A bodyguard for Anna Nicole Smith claims the former Playboy playmate was "obsessed" with pills.

During Maurice Brighthaupt's testimony, the bodyguard says he recalls seeing Smith's boyfriend Howard K. Stern holding up Anna's head, when she was too weak, in order to feed her pills.

Brighthaupt also says Smith's psychiatrist, Dr. Khristine Eroshevich, tried to hide pills from the playmate ... even at one point "crying and threatening to leave if she mixed alcohol and prescription drugs."

As for Stern, the bodyguard says, "Oh, he said she can handle it. Anna can handle it."

Eroshevich, Stern and Dr. Sandeep Kapoor have pleaded not guilty to conspiring to supply Smith with large quantities of opiates and sleep medications.

Back in 2007, Anna Nicole Smith died of a drug overdose in a Florida hotel room.

Anna Nicole Smith's Boyfriend Acquitted Of Two Charges

annasmith200.jpgLOS ANGELES, California (X17online) - Howard K. Stern had been facing two charges of obtaining drugs for Anna Nicole Smith by deceit and fraud. Both charges have now been dismissed.

In addition to dismissing those charges, Superior Court Judge Robert Perry also dismissed a portion of the charges against Stern and Dr. Sandeep Kapoor. However, the 11-count complaint involving the two men will go before a jury for a verdict.

Closing arguments are scheduled for Monday.

Anna Nicole Smith died back in 2007 of a drug overdose.

Anna Nicole Smith Portrayed As Coconspirator By Prosecutors

annasmith200.jpgLOS ANGELES, California (X17online) - Prosecutors in the Anna Nicole Smith drug trial are now portraying the former Playboy model as a coconspirator.

The legal team alleges that Smith pressured the two doctors and Howard K. Stern into giving her a large amount of prescription drugs.

In court, Deputy District Attorney David Barkhurst claimed the model was in extreme physical and emotional pain when she started taking opiates and sedatives that included Vicodin, Dilaudid and Methadone. Despite witness saying that Smith needed the drugs for medical reasons, Barkhurst told the judge, "Anna needed her Methadone because she was addicted to it."

Lawyers for Doctors Sandeep Kapoor, Khristine Eroshevich and Howard K. Stern have portrayed their clients as "caring people."

Anna Nicole Smith died in 2007 after an accidental overdose in Florida.

Howard K. Stern Found Guilty In Anna Nicole Smith Drug Trial

ANSMITH061205_01_200.jpgLOS ANGELES, California (x17online) - Anna Nicole Smith's former lawyer/boyfriend Howard K. Stern was found guilty of two counts of conspiracy today in a Los Angeles courthouse, for enabling Smith's prescription drug problem.

Stern, along with Smith's two doctors, Khristine Eroshevich and Sandeep Kapoor, were all charged with conspiring to enable Smith's drug addiction, and their use of various aliases to obtain these prescriptions. Eroshevich was convicted of four counts, while Kapoor was cleared of all counts.

After the hearing Stern told reporters outside of court, "Everything related to the appropriateness of the medication, I was acquitted of."

Howard K. Stern was acquitted of seven other charges involving Smith, and is currently free pending an appeal. He is due back in court January 6 for sentencing.

Wikileaks Cable Shows Anna Nicole Smith Almost Endangered Bahamian Government

ANSMITH061205_01_200.jpgSAN JUAN, Puerto Rico (X17online) — Wikileaks latest cable release shows Anna Nicole Smith was involved in a scandal with a string of Bahamian officials that almost endangered the whole government.

A November 2006 document, reportedly written by Deputy Chief of Mission D. Brent Hardt reveals:

    "Not since Category 4 Hurricane Betsy made landfall in 1965 has one woman done as much damage in Nassau. Lying in disarray in her wake are Doctor's Hospital, the Coroner's Court, the Department of Immigration, local mega-lawyers Callenders and Co., formerly popular Minister of Immigration Shane Gibson, and possibly Prime Minister Christie's PLP government."

The cables show how Smith quickly gained permanent residency only a month after filing, even though the process sometimes takes years and requires ownership of a property. They also reveal how the alleged bungling of her son's treatment and death cut short the careers of several lesser officials. The government fell two months after the last cable was written.

Officials denied any wrongdoing. Gibson resigned in February 2007 after a local newspaper published photographs of him embracing Smith in her bed. He has not commented on the Wikileaks cable.

Howard K. Stern A Free Man In Anna Nicole Smith Case

HowardSternEroshevich1013_01_200.jpgLOS ANGELES, California (X17online) - The judge in the Howard K. Stern drug conspiracy trial involving Anna Nicole Smith just made Stern a free and innocent man when the judge threw out the jury's verdict, ruling it baseless.

Stern was charged with conspiring to fuel Anna Nicole Smith's drug habit and was found guilty of 2 counts of conspiracy, but not guilty on 7 other charges.

The judge also ruled psychiatrist Khristine Eroshevich was actually acting out of concern for Smith and sentenced her to just one year of probation and a $100 fine for obtaining a Vicodin prescription under a false name.
